So, if we are tasked with creating disclosure regulations for assets, that is not an endorsement.”

Peirce has been openly critical of the SEC’s enforcement-style approach towards the crypto space. For instance, she and Commissioner Mark Uyeda disagreed with the SEC’s enforcement action against Impact Theory’s non-fungible token (NFT) sales in August. They argued that the vague promises made by the company to build the brand and increase the resale value of the items do not constitute an investment contract.
